These Terms are an agreement between you and Simplefield ("we", "us"), which runs ImageLab at simplefield.jetcode.co. By creating an account, you agree to these Terms. Our Privacy Policy explains how we handle your data. If you don't agree, don't use ImageLab.
1. What ImageLab is
ImageLab is a web studio for making ad images with OpenAI's image models. You write a brief, choose ad placements, generate and edit images, and keep them organized with a Library, brand kits, ad sets, a Gallery, Compare and a Spend view.
ImageLab doesn't make images itself. It sends your requests to OpenAI with your own OpenAI API key.
ImageLab is free. We don't charge you anything, and there are no payments in the app. ImageLab is new and still changing, so features may change and it may sometimes be unavailable.
2. Your account
- You must be at least 18. If you use ImageLab for a business, you confirm that you can accept these Terms for it, and "you" includes that business.
- Sign up with an email address you control, and verify it. Each account is for one person. Don't share it.
- Keep your password secret. You're responsible for what happens in your account. If you think someone else has used it, tell us at hello@simplefield.ai straight away.
- While sign-up is invite-only, you need an invite link to join. Invites are personal.
3. Your OpenAI key and what it costs
- You bring your own OpenAI API key, and OpenAI bills you directly. Every image you generate or edit in ImageLab is charged to your OpenAI account, at OpenAI's prices and under your own agreement with OpenAI. We never see or handle your payments.
- You're responsible for all OpenAI charges from requests made through your account.
- We recommend a restricted key: in its own OpenAI project, allowed to make images only, and with a monthly budget. The setup guide in ImageLab shows how. The budget you set at OpenAI is the real limit on what you can spend.
- Spend figures in ImageLab are estimates based on OpenAI's published prices. Your OpenAI bill is final. The optional monthly limit in ImageLab stops new runs once your estimated spend reaches it, but runs already in progress still finish and are billed.
- We store your key encrypted. We use it only to run the requests you make, and to test it when you save it. You can replace or remove it on your Account page at any time. If you think your key has leaked, also revoke it in your OpenAI account.
- ImageLab isn't made, endorsed or supported by OpenAI. You must follow OpenAI's terms and policies for your OpenAI account. If OpenAI limits or closes your account or key, ImageLab can't make images for you.
4. Acceptable use
You must follow the law and OpenAI's Usage Policies. They apply to everything you make with ImageLab. Don't use ImageLab to:
- create any sexual content involving minors, or any content that exploits or harms children;
- create illegal content, or content that harasses, threatens, defames or sexually exploits anyone;
- deceive people, for example with fake endorsements, impersonation, false claims in ads, or realistic images of real people who haven't agreed to them;
- infringe copyright, trademarks or other rights, including by uploading logos, photos or other material you don't have the right to use;
- send spam, spread malware or run scams;
- get around OpenAI's safety systems, or our rate limits, storage quotas or bot check;
- access, or try to access, another user's account, data or key;
- probe, scan or test ImageLab's security without our written permission;
- overload or disrupt ImageLab, or use it through automated scripts or scraping;
- resell ImageLab, offer it to others as a service, or share your account.
You're responsible for the ads you publish. Make sure they follow the rules of the platforms where they run, such as Meta's Advertising Standards, and the advertising laws that apply to you.
5. Your content
- Your content is what you put into ImageLab (briefs, prompts, ad copy, notes, brand kits, and uploaded images, logos and masks) and the images made for you.
- Between you and us, your content is yours. We don't claim any rights in it. OpenAI's terms govern the rights between you and OpenAI.
- You allow us to store, copy, process and send your content only as needed to run ImageLab for you: to show it to you, send it to OpenAI when you ask, back it up, and export or delete it when you ask. This permission ends when your content is deleted, apart from backup copies until they expire, as the Privacy Policy explains.
- You confirm that you have the rights to everything you upload.
- AI-made images can contain mistakes, can look like existing works, and aren't unique. Other people may get similar images. Check every image before you use it.
- We look at your content only when we need to: to keep ImageLab running, to look into an abuse report or a security problem, or to comply with the law.
- We don't sell your content, and we don't use it to train AI models.
6. Limits
- Each account has a storage quota, 2 GB by default. Uploads and new images over the quota are refused until you free up space.
- Rate limits apply to sign-up, sign-in, password resets, key checks and image generation. The limits on your OpenAI account apply too.
- We may change these limits. Before we lower your storage quota, we'll tell you in the app or by email.
7. Suspension and closing accounts
- You can stop using ImageLab and delete your account at any time on your Account page. Deletion removes your account, your key and your content, and it can't be undone. Export your data first if you want a copy.
- We may suspend or close your account, or refuse a request, if:
- you break these Terms or OpenAI's policies;
- your use puts other people, other users or ImageLab at risk, or could make us legally liable;
- the law requires it.
- When it's reasonable and lawful, we'll tell you why and give you a chance to respond or to export your data. For serious or repeated abuse, or a security risk, we may act without notice.
- A suspended account can't sign in or run generations. If we close your account, we delete your data as the Privacy Policy describes.
- We may change or stop ImageLab. If we shut it down, we'll email you at least 30 days before, so you can export your data.
- Sections 5, 9 and 10 still apply after your account is closed.
8. Reporting abuse
To report content made with ImageLab that breaks these Terms, email hello@simplefield.ai. Say what you saw, where and when, and include any links. We review every report, and we may suspend an account while we look into it.
Report security problems privately to the same address. Don't test them against other users' data.
9. No warranty
ImageLab is free and provided "as is" and "as available". As far as the law allows, we don't promise that it will be uninterrupted or error-free, that it will suit a particular purpose, or that its images will be accurate or right for your ads. Keep your own copies of anything important. You can export all your data at any time.
10. Liability
- Nothing in these Terms limits liability that the law doesn't allow us to limit, such as for fraud, for death or personal injury caused by negligence, or under consumer protection laws that apply to you.
- Apart from that, and as far as the law allows:
- we aren't liable for indirect or consequential losses, or for lost profits, revenue, data or business;
- we aren't liable for charges OpenAI makes to your key, or for anything OpenAI does or fails to do;
- our total liability for all claims about ImageLab is limited to 100 euros.
- If you use ImageLab for a business, you'll cover our reasonable costs from claims by others that arise from your content or from your breach of these Terms.
11. Changes to these Terms
We may update these Terms. Each version has a date, and we record which version you accepted. For significant changes, we'll email you or show a notice in the app at least 14 days before they take effect. If you don't agree with them, you can delete your account before then. Changes that the law requires may take effect sooner.
